Private Hire Vehicle Licence Application

Section 57(3) of the Local Government (Miscellaneous Provisions) Act 1976 provides that it is a criminal offence to knowingly or recklessly make a false statement or omit any material particular in giving information in connection with an application.

You must confirm each of the following statements before continuing to make an application:

You have an image of the Vehicle Registration Document (V5) ready to upload, it must include all pages, see example. – If this shows you are not the registered keeper, you must clearly show you are the proprietor or part-proprietor by providing a document such as a vehicle hire agreement.

You must have valid vehicle registration to continue this application.

You have an electronic copy of the current Vehicle Insurance Certificate/Cover Note ready to upload – The insurance must clearly show who is insured to drive the vehicle and that the insurance for the vehicle includes for Private Hire use pre-bookings only.

You must have valid insurance to continue this application.

You must have a photograph or scanned copy of a valid MOT certificate (or vehicle is brand new with delivery miles only) – The MOT must be dated within a 10 day period of the making of this application and be issued from a City of Wolverhampton Council approved VOSA testing station. See list.

You must have an up to date MOT certificate to continue this application.

The vehicle meets the Council’s Private Hire Vehicle licensing requirements.

The vehicle must meet all of the Council's Private Hire licensing requirements.

I have a basic DBS certificate issued within the last 12 months or I am a driver. – From 1 April 2021, if vehicle licence applicants are not a driver licensed by City of Wolverhampton Council, you must provide a Basic DBS certificate from the UK Government. If the applicant is a company or partnership, each director and partner must provide a basic DBS certificate. Certificates must be dated within the 12 months prior to application. You must upload your basic DBS certificate as part of the application process. If the DBS certificate contains information, a hearing may be required to be held to determine whether the individual is fit and proper to hold a licence, in consideration of the Council’s ‘Guidelines Relating to Relevance of Convictions and Breaches of Licence Conditions’, prior to the licence being granted.

You are aware of your responsibility to provide a Criminal Record Certificate or equivalent if you have spent three or more continuous months outside the UK since the age of 18. – If you have spent three or more continuous months outside the UK since the age of 18, you must check here to find out how to obtain a Criminal Record Certificate, Certificate of Good Conduct or equivalent from each of the countries you spent time in. If you have spent three or more continuous months outside the UK on multiple occasions, you will need to provide a Criminal Record Certificate, Certificate of Good Conduct or equivalent from each relevant country. If you are unable to obtain any of the above, you will need to provide references from official individuals or organisations who can confirm your conduct during your time in the relevant country instead. Personal references are not acceptable. You are required to provide these documents as part of your application. The licensing authority provides information to the National Register of Taxi Licence Refusals, Revocations and Suspensions (NR3S), a mechanism for licensing authorities to share details of individuals who have had a hackney carriage or Private Hire Vehicle (PHV) licence suspended, revoked, or an application for one refused. This is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the licensing authority – that is, assessing whether an individual is a fit and proper person to hold a hackney carriage or PHV licence Therefore:
- Where a hackney carriage/ PHV licence is suspended, revoked, or an application for one refused, the authority will automatically record this decision on NR3S.
- All applications for a new licence or licence renewal will automatically be checked on NR3S. If a search of NR3S indicates a match with an applicant, the authority will seek further information about the entry on the register from the authority which recorded it. Any information received as a result of an NR3S search will only be used in respect of the specific licence application and will not be retained beyond the determination of that application.
The information recorded on NR3S itself will be limited to:
- name
- date of birth
- address and contact details
- national insurance number
- driving licence number
- decision taken
- date of decision
- date decision effective
- date of any subsequent change to the decision, and the date it takes effect, if different
- if a suspension, the date on which the suspension is to end
Information will be retained on NR3S for a period of 11 years.
This is a mandatory part of [applying for] [being granted], a hackney carriage / PHV driver licence. The authority has a published policy on the approach it will take to requests by other authorities for further information about entries on NR3S, and about the use it will make of any further information provided to it. Information will be processed in accordance with the Data Protection Act (DPA) and General Data Protection Regulation (GDPR). Any searches, provision or receipt of information of or under NR3S are necessary to the authority’s statutory licensing functions of ensuring that all drivers are fit and proper to hold the applicable licence. It is not intended that any NR3S data will be transferred out of the United Kingdom. If you wish to raise any issue related to the data protection legislation, including by relying on any of the rights afforded to data subjects under the GDPR, you can do so to the authority’s Data Protection Officer. This includes submitting a subject access request.
